Payment Terms & Refund Policy
Payment Processing
All payments are processed securely through Stripe, our trusted payment processor. We accept major credit cards, debit cards, and other payment methods supported by Stripe's platform.
Payment is required prior to or at the commencement of services unless alternative arrangements have been agreed upon in writing. Invoices must be paid within the timeframe specified on the invoice.
Non-Refundable Policy
All payments made to Growing Global are non-refundable unless explicitly stated otherwise in your service agreement or required by Australian Consumer Law. This policy applies to strategy calls, consulting packages, and all other services.
In cases where Australian Consumer Law mandates a refund (such as for services not provided or major failures in service delivery), Growing Global will comply fully with all legal requirements. Refund requests must be submitted in writing with detailed justification.
Late payments may result in suspension of services and may incur additional administrative fees. Growing Global reserves the right to pursue collection of outstanding debts through appropriate legal channels. Continued access to services, deliverables, and support is contingent upon maintaining current payment status.

However, we cannot and do not guarantee specific outcomes, revenue levels, audience growth, or business success. Results vary significantly based on individual effort, market conditions, platform algorithms, content quality, audience engagement, and numerous other factors beyond our control.
Past results achieved by Growing Global or our clients do not predict or guarantee future performance. Any case studies, testimonials, or examples shared are illustrations of potential outcomes and should not be interpreted as typical or expected results.

You are responsible for conducting your own due diligence, assessing risks, complying with platform terms of service, adhering to advertising standards, and ensuring all business activities comply with applicable Australian and international laws. Your success depends primarily on your own efforts, dedication, and business acumen.
Limitation of Liability
To the maximum extent permitted by Australian law, Growing Global, its directors, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of our services or your inability to use our services. This limitation applies regardless of the legal theory upon which liability is based, whether in contract, tort, negligence, strict liability, or otherwise.
Growing Global is not liable for any business outcomes, lost profits, lost revenue, lost opportunities, business interruptions, loss of data, reputational damage, or any other commercial losses you may experience. We are not responsible for outcomes resulting from your implementation (or failure to implement) our recommendations, your business decisions, market changes, platform policy changes, algorithm updates, or actions taken by third parties.
You acknowledge that creator monetisation and digital marketing involve inherent risks and uncertainties. Platform policies change, algorithms evolve, market conditions fluctuate, and competition intensifies. Growing Global cannot control these external factors and accepts no liability for their impact on your business.
Nothing in these terms excludes or limits liability for matters that cannot be excluded or limited under Australian Consumer Law, including liability for death or personal injury caused by negligence, fraud, or misleading and deceptive conduct. Where Australian Consumer Law implies guarantees that cannot be excluded, our liability is limited to resupplying the services or paying the cost of having the services resupplied, at our discretion.
Intellectual Property Rights
Ownership of Materials
All standard operating procedures (SOPs), templates, frameworks, training materials, proprietary methodologies, software, tools, and other intellectual property created by or belonging to Growing Global remain the exclusive property of Growing Global at all times. This includes materials provided to you during the course of service delivery.
You are granted a limited, non-exclusive, non-transferable licence to use provided materials solely for your own business purposes during and after the service period. You may not reproduce, distribute, sell, licence, or otherwise commercialise Growing Global's intellectual property without express written permission.
Custom Deliverables
Custom deliverables, strategies, and work product specifically created for you as part of paid consulting packages remain the property of Growing Global until all invoices related to that work have been paid in full. Upon full payment, ownership of custom deliverables transfers to you.
However, Growing Global retains the right to use anonymised versions of strategies, methodologies, and approaches developed during your engagement in our future work with other clients. We will not share your confidential business information or identify you without permission.
Prohibited Uses
You may not reverse engineer, decompile, or attempt to derive proprietary methodologies from Growing Global's materials
Trademarks
Growing Global's name, logo, and branding are protected trademarks and may not be used without authorisation
Third-Party Rights
You are responsible for ensuring your content and business activities do not infringe others' intellectual property rights
Australian Consumer Law Compliance
Consumer Guarantees
Our services come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a remedy if our services fail to meet consumer guarantees, including the right to services provided with due care and skill, fit for purpose, and delivered within a reasonable time.
Fair Trading
Growing Global is committed to fair trading practices and compliance with the Australian Consumer Law. We do not engage in misleading or deceptive conduct, false representations, or unconscionable business practices. All marketing and communications reflect genuine service offerings.
Your Rights
Nothing in these terms removes or limits your rights under Australian Consumer Law. If there is any inconsistency between these terms and Australian Consumer Law, Australian Consumer Law prevails to the extent of the inconsistency.
If you believe Growing Global has failed to meet consumer guarantees, you should contact us immediately to discuss remedies. We are committed to resolving disputes fairly and in accordance with Australian law. You also have the right to seek assistance from consumer protection agencies or pursue legal remedies through appropriate channels.
For services under AUD $100,000, if there is a major failure with the service, you are entitled to cancel the service contract and obtain a refund or to compensation for the drop in value below the price paid. You are also entitled to be compensated for any other reasonably foreseeable loss or damage resulting from the major failure.
Termination & Service Suspension

Termination Rights
Either party may terminate services by providing written notice as specified in your service agreement. Growing Global reserves the right to terminate services immediately if you breach these terms, fail to make required payments, engage in abusive behaviour towards staff, or use our services for illegal purposes.
Upon termination, you remain responsible for payment of all fees for services rendered up to the termination date. No refunds will be provided for unused portions of prepaid services unless required by law. Growing Global will provide any completed deliverables upon receipt of full payment.
Consequences of Termination
After termination, your licence to use Growing Global's intellectual property expires immediately, except for custom deliverables that have been fully paid for. You must cease using any proprietary materials, templates, or methodologies. Outstanding invoices become immediately due and payable.
General Provisions

Governing Law
These terms are governed by the laws of Australia and the state or territory in which Growing Global operates. Any disputes will be subject to the exclusive jurisdiction of Australian courts.

Modifications
Growing Global reserves the right to update these terms at any time. Material changes will be communicated via email or website notice. Your continued use of services after changes indicates acceptance of modified terms.

Severability
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement
These terms, together with any service agreements or engagement letters, constitute the entire agreement between you and Growing Global regarding our services and supersede all prior communications and proposals.
